Since he obviously did not have a weapon nor did he actually get close enough to attack Trump he was charged with only misdemeanors and given, I believe ,$1000 bail. He paid it and will come back later to plead and face trial on his charges.
The argument is that no checking into his story was done after he was detained. If they had done a cursory search on him and found him making threats to attack the candidate and be a martyr they may have seen cause to keep him in custody for longer and possibly charge him with the threats.
I see nothing wrong with them letting him go free. I'm sure he is learning that everyone online already has a lot of his personal info and the sun is going down. Perhaps by morning he'll be begging to go back to the station?
