Yes, yes it is. It gives you the RIGHT to say, whatever the fuck you want. What it doesn't do, is protect you from consequences, which is exactly the title of this post. That person was able to say what they wanted, no one stopped them from saying what they said. They had the right to speak out. However, the employer also has a right to not have his employees talk bad about his company, in a public setting. Even in a non-right to work state, you can be fired for posting shit on facebook.
Here is some relevant case law, to prove my point:

In the last case, a sheriff was fired for simply liking a page, and was fired, and it was upheld by the Supreme court.

I think there would be consequences. Not sure I see your point. Its against the law to discriminate.
