Seriously... You said constitutional. I am asking what amendment formed the FBI. The FBI was created pretty much the same as homeland security. Congress want even in session when it was created. It was made because the president wanted more police power. While it isn't unconstitutional per se it isn't a constitutionally dictated agency. If it can't be reigned in it should be dismantled. Seeing as how there a rogue agents inside that are deciding to follow their own coffee if justice that goes against the interest of the country then one of those two things need to happen.

I know what you are going for but you just described a beauracracy not an actual policing agency like the FBI. Plus that is not what the FBI does. They are an independent police force that is not constrained by state boundaries. They were created to cut through the red tape of jurisdiction problems. By your definitions the TSA is constitutional. There are far too many policing agencies. You should look at the homeland security chart. It is rediculous.
