Same reason Hillary wasnt charged, Same reason Comey wasnt charged, same reason Rosenstein still has a job, same reason Sessions still has a job. Same reason (insert politician/upper level bureaucrat here) was never charged. Nobody ever gets prosecuted in washington because both sides are involved in the same shady shit. If one presses the issue the other side will do the same when it is their turn. The only people that have to worry about the law are the proletariat.

The people that consider it unconstitutional haven't read the constitution. The Executive branch has a monopoly on diplomacy under Article 2 section 2.2.

It is a crime to impersonate an officer, we all know and accept this, no one challenges it as a 1st amendment protection and people go to jail for it.

It is a crime to impersonate an FBI agent, we all know and accept this, no one challenges it as a 1st amendment protection and people go to jail for it.

It is a crime to impersonate a diplomat, why is it hard for us to wrap our heads around why meddling in foreign affairs under the false pretense of representing the US government is a crime? This is what the Logan Act was written for--to prescribe the penalty for impersonating a diplomat.

We need to prosecute Kerry and make an example of him. He needs to go to federal prison for three years.

I am surely going to get downvoated for not saying its a conspiracy, but seriously the reason he isnt being prosecuted under the logan act is the same reason no one ever has been prosecuted under the logan act. The logan act clearly violates the first amendment, and any federal prosecutor knows that actually trying to use this law will just result in the courts throwing it out.

Exactly, because they know they can get away with those prosecutions because they know that 4 supreme court justices unironically say that the second amendment was written to give the government the right to bear arms only. There are no supreme court justices currently who say the 1st amendment only gives the government the right to free speech.

Then my speech is protected by the first amendment, even though I have 100% violated the logan act, without impersonating a government official in any way.
