I don't know the full story in the US, but as I understand it here in the UK we have freedom of expression under article 10 of The European Convention On Human Rights. There are a lot of exceptions in the implementation accepted by parliament, so I guess they could make a case against most things if they really wanted to. There is currently a right of appeal to the European Court Of Human Rights (not part of the EU) but The Conservative Party want to withdraw from that if they win the election, so after that who knows
