He would have to formally accept the nomination. If he doesn't want to end up like the rest of her enemies he'd be smart to deny it and make an excuse as to why he did it. Even if he did take it and won the presidency he'd go back on all the outlandish claims he made while he was running because his political views are good in theory but completely impossible. At that point all of his supporters would literally explode.

As far as I know, according to the bylaws of the DNC, since he received the highest number of votes besides Hillary, it would be his.
