I am not saying there is no basis in law or anything.

But, what is the basis in law for forcing people to remove their masks? Can they also force them to remove their belts, and hats?

Or is it just "items" that mask and prevent the user from being identified?

The laws have been around for awhile, but the police have discretion in enforcing them. Which means unless they have reason to believe there is a high possibility of you committing a crime while wearing a mask in public, they probably won't harass you.

Ironically, these laws became common place in the US as a way to combat anonymous crimes committed by the KKK.

It's not the mask itself -- it is illegal under the California penal code, section 185 PC for persons to wear a mask or disguise for the purposes of concealing their identity to the police.

...during the commision od a crime (offense). Once you vandalize sonething ot hit someone, while wearing a mask, you can be charged with wearing a mask during a crime.
But being at a "political" event ia not a crime. I dont like "antifa" but this arrest bothers me too.

I believe it varies by state. The better question is, why was is allowed before, and not now?

because the faggot mayor of berkeley arreguin was not previously known to be part of bamn which has been directly responsible for antifa violence, also the mayor appointed a 'progressive' police chief that did lots of 'community outreach'.

Until this was published, they were giving each other handjobs at city meetings. Now the cops can't keep doing that without I would hope the national guard being called in with rubber bullets and rock salt.

I like this response. This is along the lines of what I remember from a multicultural issues in criminal justice course I remember. Specifically in targeting individuals attending an ethnic or racial festival. How can you justify targeting a suspected Tongan gang member at a Tongan festival? It becomes pretty fucking stupidly complicated. You would assume or hope that the majority of peaceful protesters would police their own group and turn against anyone in their ranks who did anything criminal. Unfortunately it does not work this way, the police then have to take into consideration the safety of all. I completely agree, this was caused by their own actions, they created this, and have caused damage to others protesting along the same side. This is just an example of what happens when attention is focused the way it has been on Berkley, anywhere.
