I think you are right...my bet is that there is communication showing that the news agencies knew they were lying and that the lies were coordinated . discovery is what going to be a problem for the news agencies.

I find these cases a win win for POTUS. If he wins he establishes precedent. If he loses he has spotlighted the need for legislative reform.
