i think now that trump has the majority in the supreme court, a military tribunal can be brought to a vote and since the numbers now favor trump they have what they need to proceed with the tribunals.

During Lindsey Graham’s questioning of Kavanaugh during the hearings, Lindsey asked about civilians being tried in a military court. Kavanaugh responded with “it is Supreme Court precedent” and “long established law.” If that is the case, the only thing ensuring the military tribunals is a previous decision of the SC that can be reviewed or overturned during the courts in the case of a suit.

Graham ensured that Kavanaugh recognized the precedent during his questioning. Otherwise, the courts could rule the tribunals unconstitutional as soon as it turned against the deep state. This is likely why everything was on hold until after the confirmation.

The SC will become involved when complaints are made concerning the constitutionality of MT for US citizens (in this case traitors).
