Does that new #3 need to be someone already confirmed by the Senate? Have there been suggestions about who it may be? Doesn't look like it really matters, but may be another opportunity to force laxative on the DS!!

With the resignation of Rachel Brand on February 8, 2018, Francisco became the third-ranking official in the Justice Department; he would be in charge of the Mueller investigation should the second-ranking official, Rod Rosenstein recuse himself, quit, or be fired.

No, the #3 does not have to be confirmed by the Senate per Sessions reorg. I believe that if RR recuses or is fired, the Solicitor General takes over as Acting AG. That's Noel Francisco. OR I may be wrong and SB2 may have something with Sessions taking over in RR's role. Either way, looks like the LAST firewall will be gone and then it will become a turkey shoot!
