Cry all he wants, but he voluntarily offered up that he has a “mental disability” and asked if it would preclude him from advancement. Once he said it, all legal protections went out the door. He can’t put the toothpaste back into the tube.

Ok, maybe not all. Most. :) As a hiring manager / HR / potential employer, there are a LOT of questions that cannot be asked and areas that cannot be probed: is someone married, what their religion is, straight or gay, political alignment, health issues, membership in the KKK or Black Panthers, etc. however there is nothing to prevent a potential candidate from sharing that information, and once they do, it is fair game to discuss with the candidate and with peers as part of the inerview and election process.
