Before 9/11 they were getting warrants, and considering programs like THINTHREAD. It was only on Sept 11, 2001, that Cheney & Addington asked Tenet to expand his powers.

Before 9/11 they already had data collection of all emails and other electronic communications. They may have obtained an occasional warrant here and there but they already had access to a tremendous amount of collected data. They were never on our side.
