The FBI can't prosecute anyone. They can only recommend prosecution. Congress are the dickheads that won't prosecute.

The Fifth Amendment states that

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury [...]

The Federal Department of Justice is the entity which convenes Federal Grand Juries; so it is with them that your beef lies.

Congress, specifically the Senate, can only prosecute a president after the House has levied the charges.

It's the DOJ that appoints the prosecution.
