And it hadn't even gone into effect yet. Obama wrote this up in December as a political landmine on his way out of the oval office. The real solution here is to remove all barriers preventing ISP's from forming. That's what Romania did, and they quickly rocketed up from 128 Kb/s connections into gigabit internet speeds. So much competition popped up, that there are as many ISP's as there are neighborhood blocks, and it's typically just a 1-2 person group running each one. If one of them decided they wanted to sell your information, you could choose one of the other 250 providers around you. In highly competitive environments like that, doing ANYTHING that the consumer doesn't want would be suicidal for your business.

This is starting to happen in the U.S., in an evolved form. Look into the darknet plan (/v/darknetplan /r/darknetplan). It's a decentralized meshnet that incentivizes nodes in a similar way to how bitcoin incentivizes miners (though the incentive factor is a work in progress), and the traffic is also encrypted end to end. So nodes can't eavesdrop on the network.
