No, it's almost certain that this guy is guilty. See, they DID get into his MAIN hard drive, which had logged him downloading child porn. They don't have the child porn, however, because he either never saved it because he was disgusted by it, or he saved it on the huge encrypted drives he has in the corner.

That's why you and I should assume he's guilty, as long as we don't have to be on a jury, or preside over his case.

Not discussed: How did they get into his main drive? Wasn't that encrypted by Apple's thing?

Regardless, if they end up finding a bunch of crap on his drive, then I doubt that argument would save him. The very real possibility of being framed by any of the companies that have legit access to his machine in some fashion, or anyone who had technical means, or simply a bad friend or relative, is almost never brought up. A legally relevant point, but probably not one that would come up here.
