Note that there isn't any mention of how Whatsapp's supposed end-to-end encryption factors in here, they just aren't transparent about their policies regarding data retention and government requests. The headline is rather baiting, as it doesn't make it clear who the data isn't kept safe from, or how the data isn't being kept safe. The EFF page is more clear.

I'd be interested to see a teardown/analysis of it, personally. Some other rather large companies have implemented it (Apple in particular), and it seems that Whatsapp runs with a decent amount of autonomy within Facebook, kind of like Oculus, don't screw with a good thing.
