That would certainly slam the brakes on the Trump train for me, but it's probably more of a commentary on the sad state of politics these days that I'm willing to overlook this. At least I can tell myself the NSA never really stopped, anyway.

I begrudgingly catch myself agreeing with Trump on most things, except this. Yes, I know he wants to put checks in place for this, but I believe freedom is far more precious than security.

In aggregate, I wonder which viable candidate will increase our overall freedoms and which will further restrict them.

viable candidates? none of them. The system has a vested interest in keeping them from reaching viability. We're stuck with a choice of "in what fashion do we want to be injured" and "what TYPE of freedom do we most want to preserve?"

What I think is that Trump is reasonable. He's running for office now, so he's not going into detail. If actually in office, when presented with these questions, I suspect he'd frame it in the same way you do. Trump is no idiot, and he knows the arguments for and against. He knows that the Bush/Cheney admin set up the system to bypass and ignore the 4th amendment and he knows that the Obama administration has failed to address that. It's consistent with his other positions in that he's PUSHING FOR A CONVERSATION.

When Bush put these things into place IT WAS A SECRET. Future/other politicos proceeded to not discuss it, either. Trump is asking the public to have the conversation. If everyone stands up and says, "No, now that you mention it, we'd rather not have this" he's going to go "OK, you had the choice and you made it, don't complain if you get blasted by a bomber."

This is what needs to be noticed and appreciated - Trump is continually blowing the doors off issues that are deliberately swept under the rug by the political class.

It is entirely possible to have a minimalist government that punishes people for killing each other and stealing from each other, defends the nation's borders and even provides some help for people who are struggling, without stepping on people's rights and freedom. I know. I remember living in a pre war-on-terror America that was an awful lot like that.

So what he's actually proposing is increased oversight and a warrant requirement, which is of course the whole problem with the 4th-amendment violating NSA sweep.

I'm glad someone else knows about this court. My thoughts immediately went to this. When you have that much power readily available, obviously you're going to make sure that that "court" is packed full of yes-men.

The only reason the existing 'courts' do that is because they were setup by the Bush/Cheney admin to do exactly that. They're intended to bypass 4th amendment limits and protections. Any actual court designed for this purpose would not do so. it's absolutely criminal, the way in which the system was set-up. Alberto Gonzales should be hanged.
