No managing your cash flows so that you do not need to beg for the help of an already burdened court system is the prudent thing to do. It is long past time to overhaul bankruptcy and receivership in this country.

but even when there are glaring loopholes like that, you think that everyone should just avoid them? he's smart enough to see a really easy shortcut, and, as a good businessman, uses it because its a safe way of clearing debt. its just good business

Tell that to his creditors. It is not good business. Good business is creating stable cash flows over a long period of time. Good business is not taking as much money as possible for far fetched projects; taking some of the money and then going.... Oops it did not work, please court system give me relief.
