This is not 19 century and today's courts take a long time to get to any verdict,never mind those where death penalty might be involved. They have a lot more tools to help them arrive to proper verdict,whatever that might be. Chances of erring are very slim to none.

Yet there have been recent cases where DNA evidence has exonerated someone previously on death row. We might be getting to a point where erring are slim to none if you assume no bad actors on the government side but I don't think we are at a point where we are close enough to 100% certainty to summarily start killing people in the courtyard right after a sentence is handed down.
