Friendly reminder that the purpose of judicial review is not to determine if something is right, but to determine if something is legal. The assumption is that Congress will decide if it is right or not.

Of course Congress is usually wrong, but I digress.

A very good point. The court's hands are tied by whatever is lawful/unlawful. I guess the question here is whether the NSA's spying is constitutional, which trumps anything Congress can come up with.

Edit: as the author also points out, it's baffling that the court first declared that NSA spying was not justified by the Patriot Act, then Congress authorized the USA Freedom Act that would temporarily extend NSA's spying, then the court reversed its initial decision and declared the whole thing legal again. The whole thing is hard to follow.
