They will both be charged and convicted of first degree murder.
They will spend the next thirty years in solitary or 30 years of getting the shit beaten out of them everyday.

No, they wont be charged, because they didn't break the law. A citizens's arrest of a fleeing suspect isn't breaking the law. The two men in the pickup didn't charge anyone. The thief charged someone holding a shotgun, thereby causing it to discharge. Case closed.
