To be fair, that case was a matter of prosecutorial overreach. McDonnell and his wife were exposed as vile people, but the prosecutors never should have pushed their case the way they did given the actual facts they had and the law as it was written.
Should what they did be considered graft for which they could be prosecuted? Possibly, a majority of us would agree. But in that case, you need to pass a law that actually properly defines the crime. You don't decide on a novel reading of an existing law which doesn't actually cover the provable behavior.
At least that is how it works everywhere but New York. The way their last few state's attorneys general have abused their power under the Martin Act sometimes makes it seem like they just define criminal behavior against People they dislike for purely political motives on an ad hoc and after the fact basis.
