The court did not declare CNN’s reporting to have been erroneous, examine the overall practices of CNN outside of Carbone’s complaint, nor say (or even hint) that the station deals in “fake news.” The ruling did not even constitute a final judgement in favor of the plaintiff, as it simply established that Carbone had sufficiently proved grounds to proceed with his lawsuit against CNN.

It's funny how these places call others "fake news" while pushing this stuff.

Judge Orinda Evans, from the 18 page order she handed down:

The Court finds these allegations sufficient to establish that CNN was acting recklessly with regard to the accuracy of its report, i.e., with ‘actual malice.

Sure, but that is because at this point of a proceeding for this type of motion, the court looks at the allegations in the complaint for sufficiency in stating a claim but without determining if they are true or false. The court assumes they are true (or at least is supposed to look at any disagreements in favor of the party not moving for dismissal).

So as long as the pleading makes a prima facie case, it is allowed to go forward. The only thing the court found was that his attorney drafted an adequate complaint and so they can proceed to trial. If he gets to court and can't prove any of the things he is claiming about CNN, he will lose.

TL;DR -

Judge Orinda Evans' ruling dismissed the CNN motion to have the case thrown out. It will now move forward.

Of course, that wouldn't demonstrate how smart you are.

No...That headline belongs on CNN

This was a pre-trial hearing. The court says the case is approved to go forward. As in it won't be dismissed. The trial still has to take place. CNN has NOT been found guilty.

There will be none, actually. The judge said they were not judicially checking facts like they should, but that they actually really didn't do anything wrong. Just be more careful next time. This title is, ironically but not surprisingly, fake news.

I don't understand this...the "news" stations are under no legal obligation to tell the truth; "news" is considered a form of entertainment. And what about using the media to sexualize children...where are the court rulings on that? The truth of the matter is that the United States of America is an open sewer, and has been a malignant influence in the world for many decades...all thanks to the maleficent Jew, and his subservient Christian henchmen!

Do you have a more reputable source? Also pretty sure "fake news" would be protected by the first amendment in the US unless it creates a physical danger to someone or is very blatant slander.

Reputable sources talked about this a week or two ago. CNN lost a motion to dismiss; the trial is yet to come.
