I hate to say this, but it's the right thing to do. No agent of the government should be allowed to subvert anyone's civil rights regardless of who you are. Since he has not been formally charged yet, he is not entitled to a public defender. The ACLU stepped in to bridge that gap. It's my understanding that they will turn the defense over to whoever is appointed after he is charged.
