Can't pardon without a conviction, I don't think. Now, if she is indicted and realizes she can't get elected, she might make a plea deal so Obama can pardon her.

Two things about that though...

  1. Of Obama wanted this to go away, it would have gone away by now.

  2. She is too much of a sociopath to concede to a plea. The generally thinks she is untouchable.

The President can issue whatever pardons he likes, with or without a conviction. It's usually post-conviction, but see Ford's pardon of Nixon for a parallel.

I mean there is a case for you or i being ignorant of specific policy. However if i was head of the state dept. I would treat all information as possibly sensitive and classified and consider any communication with myself in regard to govt business to secret.

What I was trying to say is, if it is indeed the law that she's responsible for recognizing classified material then her defense that they weren't technically marked as classified seems to become a moot point, and she would probably be in real trouble, because I think they've found thousands of emails that were indeed classified but not marked as such, and to your point it would be rather hard for a Secretary of State to play completely oblivious as a defense in court.

As the head of the state department it was her job to KNOW the material was classified it and if it came to her unmarked the onus is on her to mark it and store it appropriately. She did neither.

i forget the exact reg for it but yes when you hold a security clearance and have access to classified material you are responsible for recognizing and securing classified material where ever it may be. you also have refresher courses when your security clearance is renewed on how to spot classified material. long story short she is fucked

It's worse than that - as Secretary, she was the Original Classification Authority for the entire State Department, meaning she issued/signed the policies regarding handling of classified information all employees/contractors were expected to abide by, on penalty of prosecution.

It would need to be the general election. She would have to be president elect, because if she gets indicted after the primary, then the democrats are going to lose the white house.
