The no-fly list is not subject to any public review so who knows who is on it, why they are on it, and how to get off the list. The no fly list my be a really good list and worth having or it may be total bullshit who knows?

Agreed. Until the list is public record, there simply is no telling.

And now Obama wants to restrict anybody on this secret list from buying a gun.

“These are everyday Americans that have nothing to do with terrorism, they wind up on the no-fly list, there’s no due process or any way to get your name removed from it in a timely fashion, and now they’re having their Second Amendment rights being impeded upon,” Rubio said

Correct (and good for Rubio for saying it), but denying them the right to travel is equally wrong and equally unconstitutional.

A judged ruled it unconstitutional back in 2014 but they are dragging their feet. The government was told that people had to be told that they were on the list so that citizens could appeal it. A few of the people on the list got off but for the others, I suspect the government is hiding behind state secrets privilege.

I swear: we need to fucking use temporary injunctions. CEASE THE ACTIVITY until (if at all) litigation ends up in favor of the party doing such activity.

A judge already ruled it unconstitutional but the government isn't listening to what the judge said. The ACLU is working on it though.

Sometimes, while in appeal, the defendant is not otherwise ordered to stop operations until (or if) the appeal is denied.

More temporary injunctions, damnit!

Obama wanting to ban guns to people on the no fly list is really just an excuse to take away American citizens right to bear arms without any due process. on the outside it sounds like a great idea don't sell guns to people who are on the no fly list, simple enough it even sounds like the responsible thing to do, but the reality is this is just a way to enact subversive gun legislation on everyday honest Americans. Make no mistake about it if Obama is allowed to pass this bill the no fly list is going to grow exponentially over night
