Found the problem. Take this to a jury, inject some 'reasonable' people into the mix.

I doubt it would have gone to trial, few reasonable people would convict a teenager for having naked pictures of his teenage girlfriend (which she gave voluntarily) precisely why the prosecutor let him plead out.

Prosecutors who plead out stupid cases when they know they cant get a conviction should be beaten, not badly, just like a broken arm or something. This is the kind of case where you call the arrest stupid, tell the kids that those pictures better be gone before they turn 18, and that they should be careful who they give ownership of such images of themselves, today's lover is tomorrows psycho nut-job.

I am beginning to want jury review to be mandatory, not merely a right but an obligation.

He's not being prosecuted for this. He's being prosecuted because the police/prosecutors think he's guilty of something else but this is all they could get the evidence for. I'd almost bet my house on it.

The idea of concocting ludicrous charges in lieu of the ability to prosecute someone for actual crimes is a terrible idea. If the public believe crimes can(or should) be fabricated in order to punish a perceived injustice, then this gives police the ability to arrest and charge anyone they choose, regardless of the commission of an actual crime. This is a recipe for a police state.

If the police cannot obtain evidence of a crime by legal means then we need to either modify the system so as to allow them to prosecute actual crimes, or accept the fact that in order to protect civil liberties, sometimes guilty people simply cannot be charged. Better to let a legitimate crime go unpunished than to allow for people to be punished for crimes that they have not committed.

Adulthood is determined by statute law. If you live in a state that has determined that you are an adult at 17 you better wipe your hard drive and start acting like an adult because adult penalties are harsh. A smart new rite of passage for an 18 years old should include registering to vote as well as hitting the sexuality reset button.
