Unless the violation of due process is classified and hidden away, then the defendant won't be able to prove any standing to challenge it. If they get a hold of classified information then the lawyer might just go to federal prison for bringing it forward.

if theres this legal basis, lawyers could use it for legal defense, and it could be the start of a lawsuit.
