I don't think maritime law exists in that sense, in this case he's subject to Panamanian law. The judge was correct that Spain had no jurisdiction.

If a crime was committed against a Spanish citizen, jurisdiction is reasonable. There's also no reason Panama or Italy would refuse extradition.

I think that would mean the laws of the country under whose flag the ship sales would govern. But maritime law is a whole different kettle of fish and I am not an expert. And regardless which country that would be, I’m pretty sure most countries have rape laws so it seems odd the conclusion is he cannot he tried.

Admiralty and Maritime law apply, the Captain should have known it. If she is flying the Panamanian flag, those laws apply in international waters.

Admiralty law doesn't apply outside of UK registered vessels though. He did the right thing by transferring the offender to the nearest authorities, but the Spanish prosecutors should have just investigated the case then transferred it to Panama. There was no reason to bring it before a Spanish court.

The judge is right. Unless the crime happened in Spanish waters then the law of the vessel's flag applies. The case would have to be taken by a Panamanian court.
