It's a weird case. He voted and wrote a large portion of the ruling, but died before the ruling was handed down. I guess the argument would be that we can't be sure he would not have changed his mind?
I think it's really simple. You can't make a ruling if you're not holding the office. McCain can't vote from the grave, dead Presidents can't pardon people, and dead judges can't hold court. Their slot is vacant when they die and empty space doesn't get a vote.
I'm not complaining but i feel like they announced he was dying. Seemed fine to me. Is he still alive or did they put him down? Failure to assassinate?
