Some outlets are saying a grand jury is being impaneled now (we don't yet know if that's confirmed and who's being charged and with what).

If the prosecutors call for Smollett to appear in front of the grand jury, he can't refuse to appear. He would be arrested if he refused to appear. His lawyers are smart though; they would see to it that he showed up and will accompany him in the grand jury room.

Former defense attorney here. You don't get to have a lawyer with you when you testify before a grand jury. They wait outside the room. You can go and confer with them before answering each question, but they can't go in with you.

Never talk to the cops and never agree to testify without full immunity.
