The non-US partner can't just claim US citizenship.

And I said that in my original post,

'it doesn't matter that one of the parents is married to a US citizen (straight or gay), marriage does not imply citizenship, the married partner still has to apply [for citizenship] whether they are straight or gay.'

However, being married to a US citizen, as far as I understand it, does make the process of applying for a visa, conditional PR, and then PR much much easier. I think the only way you get denied at that point is if you have a criminal record or the marriage itself is deemed a fraud (I could be mistaken).
