You know, I don't disagree with that.
But then I do also have to say that a country that does not have free speech rights as the foundational right is not actually a democratic society. Democracy is about truth telling and debate, disagreements and disagreeableness and an agreement to allow for such.
Democracy is not just the act of voting. An uninformed vote is nearly worthless.

I think we fucked up when writing Germany's constitution. We should have put free speech laws. I believe Japan's speech laws are similar to ours.

The moment we added the criminal provisions for holocaust denial, we killed any chance at free speech in Germany. Here is a good example of the dangers of banning free speech.

The Allied/American military who helped re-establish the German state must not have grasped the basis of the democratic system. That is likely the case today. Being in power does not make people wise.

Fun fact about Germany: according to law it is completely acceptable to defend your honor with lethal force. I guess they forgot about this law or somehow disabled it through other laws, but it's still there.
