What would stop the "geek squad" from putting child porn images on there and claiming they found it like that?

$500 that's a decent amount of incentive.

And jail isn't a disincentive when you're working with the government.

Absolutely nothing - one could imagine situations where they are the vector to introduce such fake evidence for parallel reconstructionism purposes. That's the messed up world we live in.

Or maybe one of their idiots copies it over to your computer by accident. Please don't overlook the possibility that the sheer incompetence of the Geek Squad morons has some potential to screw you.

The same thing that prevents them from installing government spying malware.

Nothing.

Back in 2003-2004ish, I began noticing that people accused of commiting a federal offense ALWAYS had "child pornography found on their computer(s)." ALWAYS. It didn't matter whether it was drug charges, weapons charges, tax evasion...The news article about their arrests ALWAYS had the sentence "-child porn(ography) was found on _____'s computer(s)."

So. Either all people who commit federal offenses are scumbags, and all scumbags naturally love kiddie porn, OR-

Federal cops (FBI, DOJ, ATF, who knows who else) have been remotely planting porn on people's hard drives for years now. Or they simply lie to gullible reporters about finding it...

Either way, the jury pool is tainted , PLUS the child porn "found" on the computer will so enrage the jury that a conviction is pretty much guaranteed.

What i fear is that everybody that looks for porn img online has something that would be classified as child porn on a hard drive and ip history. Some ads on those sites have jailbait age range pictures. Even browsing imagefap you get some doggy thumbnails.

For very long time in Poland you would be classified as a criminal if you went on a same server that had prohibited porn. Yes, server. So you could watch food recipes site, but if owner was hosting a porn site you were fucked. That changed when someone found that major political party had a site on a server that was hosting porn site too.

Also, the legal definition of child pornography is significantly wider than most people seem to be aware of.

Drawn stuff keeps on going back and forth over where its protected or not. I think the drawn stuff is used when they cant pin anything else. but they have to back off of it when one of there own gets caught with it.

Here in america that is

This case should have been thrown out. Or else some blurry thumbnail in a deleted cache folder is enough to ruin your life.

pretty much. there was sloppy police work the whole way through, a violation of 4th amendment rights. i deleted picture is not enough to have reasonable cause. i know the girl was 9. but erotica pics are not considered pornography because there is no sex acts.

this be reasonable cause to launch an investigation after approval from a fisa court. often times pedos are caught after months of investigation.

I also question the face that the girl was 9. Unless she was positively identified it's impossible to know. And we know they will attempt to proscuite a case of CP when they know the girl is not under age. A U.S. Customs agent and self-described expert in child pornography who concluded (presumably after viewing the video several times) that Fuentes was "13 or 14" years of age.

So an FBI agent lied, causing the courts to violate a pedos rights and thus letting him off Scott free.

The agents lied on court documents, when does the trial start. edit: grammar

We can't argue on one hand for privacy then scold the judge for throwing out the case.

Although there is a possibility the two pedofags frequent the same child porn site

I don't think it is as black and white as that. If you hire a maid to clean your house have you given up all privacy in your home to the FBI? Can she become a defacto gov agent and search your house for evidence, even if it would have nothing to do with what she was hired to do. (i.e. instead of cleaning your toilet, she rummages through your desk drawers and finds your unregistered handgun etc.)

He hired someone to fix his computer, not the FBI to search his entire HD. Was the search of the HD reasonable in the performance of fixing the specific problem?

Or the Geek Squad techs put it there, because dat $500 FBI reward.Either way, a single picture should not have been enough to get a warrant of the rest of his shit.

https://archive.fo/IHZfs :

Judge throws out child porn case against man who took his desk top to Geek Squad | National Post

' If they had done that in this case, I don’t think the search warrant would have been issued.”'

'The judge noted that Best Buy warns customers that it will notify the authorities if illicit material is found. '

'Computers taken to Best Buy stores around the country for repair are all shipped to the Kentucky facility. '

'On Rettenmaier’s computer, a technician found one photo of a naked girl, believed to be 9 years old, in the “unallocated space” on Rettenmaier’s hard drive. '

'Riddet raised the issue of whether that made the Geek Squad employees de facto FBI employees — and therefore government agents who would need a search warrant. '

This has been an automated message.

one photo of a naked girl, believed to be 9 years old... It did not show the girl’s genitalia or any sex act.

How is that child porn?

The judge said it wasn't. That is a big part of the reason the warrant was invalid.
