Well, no shit, but at least they're openly declaring their support for the Constitution on this one.
[–] go1dfish 3 points 40 points 43 points (+43|-3) 10 months ago
The constitution is worthless so long as the 16th amendment stands.
Obamacare? That's a tax
NFA? Another fucking tax
Drug war? Started as a tax after the 21st amendment failed, then they just beat the interstate commerce clause into submission.

The question is who do we elect to start seeing some of this bullshit get repealed?
We need a list of state legislators worth re-electing and another list of legislators that need to be axed (or hanged)

Avoid taxes by investing into crypto. They can't track you. And you only pay taxes on the "capital gains" you get when you convert to $USD, which you should not do.
One more year and companies like TenX will have credit cards connected to your crypto account so that you can spend your BTC and not ever have it convert to $USD, thus completely avoid capital gains tax, and really... all tax.
All taxation is theft.
It has been proven over and over again that the PRIVATELY owned roads on the East coast are better quality than the PUBLICLY owned roads on the West coast.
Who's gonna pay for the roads? The same company that the Government would have contracted with your taxes, but without the middleman, thats who.

I would argue that the seventeenth amendment is just as deadly to our republic and its repealing should be a top priority.
[–] physicscat 0 points 9 points 9 points (+9|-0) 10 months ago
When it comes to freedom of speech, the SCOTUS has been very consistent with their interpretation. This unanimous ruling is one of many.
[–] Martel-Sobieski 0 points 2 points 2 points (+2|-0) 10 months ago
Unanimously too
[–] dontkickthebaby 0 points 1 points 1 points (+1|-0) 10 months ago
The most positive thing from this is that they were unanimous. Now if only they can focus on more important things...

So this means I can name my band Nigger Willy and the Porch Monkey Quartet without getting in trouble? I gotta get my jugs.
[–] BistroPalin 0 points 51 points 51 points (+51|-0) 10 months ago
I can name my band Nigger Willy and the Porch Monkey Quartet
You've always been able to do that. Now if you apply for a trademark that covers your band merchandise, the Patent and Trademark Office will not be allowed to deny your application based on the disparagement clause, which has unanimously been found unconstitutional.
Now will you get into trouble with that band name? Well yeah probably. But not with the Trademark office, or the law.
[–] Docta_pizza 0 points 13 points 13 points (+13|-0) 10 months ago
A while back I remember reading that the the Patent and Trademark Office revoked the Washington Redskins trademark protection rights to their own logo and branding, on account of it being sooo offensive and all that. I guess that decision gets reversed because of this? That should annoy some SJW retards. Good :)

Also, it might be used against you in court if the prosecutor needs to make you look bad, especially if you're being charged with a hate crime.
[–] TheDude2 0 points 6 points 6 points (+6|-0) 10 months ago
You're telling me that I can trademark the word "nigger"?

Well can the state government penalize someone?
[–] SexMachine 1 points 9 points 10 points (+10|-1) 10 months ago
I think you and I would make a great team.
[–] BistroPalin 0 points 8 points 8 points (+8|-0) 10 months ago (edited 10 months ago)
The federal bill of rights now applies to state and local laws as well, so this ruling would negate any similar restrictions under state trademark laws. (It was not always the case historically that the bill of rights applied to state law.) However, it's probably moot since almost no one registers for state trademarks since nearly all trade is interstate and there's almost no point to getting a state trademark since federal trademark protection covers all 50 states.
[–] cthulian_axioms 0 points 0 points 0 points (+0|-0) 10 months ago (edited 10 months ago)
Not ... really. AFAIK the Feds have exclusive jurisdiction in regard to trademarks (I forget which "enumerated powers" clause it is; it's late and I am on my mobile, so we'll go with "it's the same one that covers copyright").
As for whether a State could prosecute you for "hate speech" if you were to register an ostensibly "hateful" trademark, that's a bit of a thornier question. No doubt California will try. I don't know if they'll win.
[–] Martel-Sobieski 0 points 0 points 0 points (+0|-0) 10 months ago
No. Federal trumps state.
[–] SexMachine 3 points 8 points 11 points (+11|-3) 10 months ago
I think I invented the term "porch monkey".
Bear with me, I'm pretty sure I came up with it. I can't find the term in usage prior to the 1980s, if you can, you will have proved me wrong.
So, when I was a kid, I lived in New Orleans. I went to a merit/test based public school in a majority black city. Surprise surprise, all of the kids in my class were white. So, one day we're going on a field trip, riding the bus, and the middle of the day there's always black people, just hanging out on the sidewalks, not having jobs, going about doing a whole lot of nothing. I stick my head out of the window, I'm like 7 or 8, and just start yelling "MONKEY! YOU'RE ALL MONKIES!!!"
My teacher doesn't even stop me, she's in tears laughing.
Then we get to the part of the city where there's porches, and all this black people are just hanging out on their porches, not working. I start shouting, "PORCH MONKIES! GET A JOB YOU PORCH MONKIES!! YOU'RE ALL MONKIES!!"
I was yelling out the window for a good 30 minutes, and everyone on the bus was just dying laughing. Even my friend Adam who was like half black.
The next time I heard the term "porch monkey" used was in Clerks 2, and I was like, holy fuck, did I invent the term? I've looked extensively into this, and all I can find is that it originated in the mid 1980s.... when I yelled it out the schoolbus window.
I'll be happy to be proven wrong, if someone can find usage of the word prior to like 1986.
[–] Synthicide 0 points 10 points 10 points (+10|-0) 10 months ago
Good story. Hate to burst your bubble though. I was able to find "porch monkey" in this book from 1940. Also saw in another book written in 1970 that said American soldiers in WW2 would use the term frequently as well.

Now imagine what kind of traitor would vote against this ruling.
Britain, Canada, Germany, Netherlands, Sweden, ...on and on and on.
Socialism is a corruption of the will of the individual in the service of a claimed collective interest. It is tyranny.
[–] fagnig 0 points 3 points 3 points (+3|-0) 10 months ago
Netherlands is a weird case, its both cucked in some senses and passionately free speech in others. My mind is not made up. Maybe their problems are not around free speech and at the expense of other freedoms.
But hey in this political climate who truly has their shit together except non-europeans?
[–] novictim 0 points 3 points 3 points (+3|-0) 10 months ago

Was. Past Tense.
Then Geert Wilders was prosecuted and convicted for speaking the truth against there being too many Moroccans, the chief community behind crime.

Or capitalist corporations, that completely don't care about free speach. But they're spesiul, i know.
[–] novictim 0 points 0 points 0 points (+0|-0) 10 months ago
Yes, I am agreeing with you on that in the "special" case of monopolies and near monopolies of the "public square" on line. Face book and Twitter and Youtube do, imo, have a responsibility to maintain the 1st amendment on the public square they now own and occupy. The US Citizenry and legal system have yet to acknowledge this special case.

It's bs. 90% of people aren't that sensitive about shit. It's manufactured outrage and because of the internet it gets an audience and spreads to the masses.

A huge win for the first amendment. And I mean huge. This was by a unanimous vote. That is something one rarely sees, and it is a powerful message that is going to send a shudder that will reverberate far and wide. I'm so sick of seeing the left going full on Leninist/Stalinist and using everything from legislation to character assassination and career threats/destruction and social stigmatization/incrimination in response to any dissenting opinions.
[–] mrtoker 0 points 10 points 10 points (+10|-0) 10 months ago

I used to be fully on board the libertarian bandwagon then I realized that the private sector was fully on board with everything I did not believe in. When you are summed up as an economic unit you have no meaning.
