Yes, all soldiers are committing evil acts. Some of these acts are so bad and so unnecessary even to further military goals that we try to punish the people who do them.

Yeah I see your point. Maybe there's some good, accessible ethics or legal scholarship that is able to make a good case for punishing soldiers who white phosphorus civilians but not soldiers who napalm civilians, or a case for punishing soldiers who use hollow-point bullets but not flamethrowers. Right now I guess I'm ignorant about it.
