Law is law. It's not like they're making it up as they go along. The laws are in place to prevent people from doing illegal shit. Destruction of property is not protected by the Constitution.

I didn't put words in your mouth. Also, I honestly didn't know that vandalism was a felony, and I'm not a lawyer, but I don't think they can just change the law on a whim. I would imagine that a court would have to rule that this was indeed a felony if those are the charges brought. Either way, destroying public or other people's private property is a crime, and now this guy is at the mercy of the court.
