My concern is that changing it from "perponderance of evidence" to "clear and convincing" breaks the typical argument that carrying a large amount of cash, or owning something 'too nice' is evidence in itself.
The whole concept adopted at the beginning of the 'drug war' should just be done away with entirely, not just 'made harder' for the government. They break their own rules all the time just because people are afraid or lack the knowledge and resources to fight them.
