The heavy boat pushes the other down instead of cutting it in half as up and down come into play. We see a crash and think like it is cars but there is an extra set of directions boats move in. plus at speed the boat is not as deep in the water as you might think. The real damage would have come if it had a prop hanging below the hull I would guess that was not the case on that boat.

You are legally right. Stationary, Wind powered, man powered (may have these two backwards), motor powered. Though like a person on foot and a semi legally only helps if you are still around after the accident. assume everyone else on the road/water/sky is a moron and look out for them, I would rather be legally wrong then dead right.
