The Japanese trademark laws are crazy and Nintendo took them to be the yardstick of ideal world. They are stupid. I get how this happens (a middle manager does not want to be seen as not fulfilling role he is paid for), but a smart leadership decision is to be made. Be known as a company friendly to their fans. I mean, they focus on cutesy characters and friendly, all ages fun. It would benefit them so much if they were seen as cooperative as possible.

Perhaps it's time for Nintendo to die out. They don't seem to operate in the same league as their competitors, or understand their audience, fans, or the market in general anymore. The wii and wiiu have both been doorstops with reasons to plug them in such as Splatoon so far between that many forget they even own the consoles. Maybe there is just something in the water these days, but between Konami going full retard and Nintendo turning into a litigious bully it seems like the old guard who created the games I grew up with no longer have any idea what they are doing.

They don't have to understand anything beyond "just keep cranking out Mario and Zelda games, then drop a Smash Bros every 5 years."

For what it's worth, I think their franchises are probably the main reason that people bother with Nintendo systems at all. People still love the stuff, even if it's cranked out.

Incorrect. Copyright was meant to protect initial investment in order to cause the most IP to be created in the first place so people wouldn't have to be scared to put their stuff out there with the intention being there would be more stuff out there available to the consumer.

IP doesn't protect consumers, it protects monopolies. That's what it's for. If anyone could make a mario game no one would bother buying from a company with these shitty practices and they'd be gone long ago. We'd also be knees deep in cool Mario games.
