It's not that they can't. It's that people would bitch and moan if the behavior was slightly different.
For example, let's say it sorts all the units and uses that list to determine the order in which units attack. It's an unstable sort, meaning that 2 of the same unit are in an undefined order. The original Red Alert used a crappy, buggy version of quicksort. They replace it with a state-of-the-art sorting algorithm. Suddenly, an enemy soldier that went after you on a frame is going before you now.
This is especially the case with the AI. Imagine the AI was smarter and could suddenly figure out how to get around sandbags or react to your spamming the same type of unit. Every strategy guide would be rendered useless, and... people would bitch and moan.
Diehard fans want the bugs. Diehard fans want a crappier game, as long as it's crappy in their way. Everyone else won't notice a difference.
