I wonder if it would be cheaper just to leave that lot on the wrong side of the border fence. Making it effectively no man's land, but legally still theirs, which can be taxed (if that state has a tax on land). Land would be pretty much unusable if it is on the wrong side, but most likely it is useless land now even without the fence.

Only partially true. Look up. In the 80's the land around several communities in Southern Colorado was seized to create a massive training area. The government offered "fair market value" and were told to stick it up their ass. Then the government came back and took the land and gave half of the original value and zero fucks.

In the mid 2000's they planned to expand the area again until in 2013 when the plan for expansion was scrapped by the military. If the government wants something they will take it, end of story.

Also, market value for this process isn't calculated by Sally your local realtor or based on tax records etc... the government has their own assessment teams that will inform you of what they feel is fair market value.

Someone on property hindering what could be seen as an asset to national security would have zero chance to hold onto that property. Trying to tie it up in court won't last long with this type of situation.

There is another example of one old family land/mine near restricted space in New Mexico that has fought for years and basically ended up with the shit end of the stick.

This is a publicity stunt, they're not going to even try to hold on to the land and I'll tell you why - they've made it perfectly clear that they intend to use their lawyer to effectively stall and bullshit their claim in court, which is an ethics violation that will lead to fines, suspensions, or even disbarment for their lawyer. Now, lawyers pull this stalling tactic all the time, but you can't come right out and say "We're going to waste the court's time". Nothing will come of this because they've essentially bragged their way out of any legitimate court case.
