Ya know, I'm pretty sure once the animal starts having weight related illnesses, you can get animal control to take them away because, unless the animal is actively on a weight loss regime, you're failing to care for it properly.

At least, my friend told me about a morbidly obese horse in her neighborhood who's legs were starting to break down under it's mass, so animal control seized it and took it to a rescue farm on grounds of neglect and cruelty...she did say though that it took about a year of several people calling for them to decide it was a serious enough case to deal with.
