Devil's advocate here, is stealing something that could be handled in a civil court and doesn't need a law? How many stores simply ignore small thefts (candy and things like that)? Overall, how does the cost of enforcing that law (courts, cops, jails) compare to the cost of ignoring some thefts and only suing (in civil court or by arbitration) the repeat offenders and big offenders? They could require the loser of the suit to pay the cost of the action.
