And really this isn't even about it being a disability. It because he said he wasn't disabled until he was denied the job, then he said he was. It's about the fact they only want to claim its a disability when they don't get their way. So abuse of the system is the only reason it's coming into question. If you don't think you're disabled until there's something you can get out of it, guess what, you're not disabled.

It's completely insane that these people claim being overweight by itself us a disability. It puts a bad image on people who have actual unpreventable impairments. There's a very small percentage of the population (likely less than 1%, not the majority of overweight people) that actual do not have very good control of their weight. Surprise surprise, those specific impairments or diseases are the disability, not just being fat.

I'm currently in a fight to receive disability for multiple, invisible debilitating conditions. On the outside I'm a normal BMI, 21 year old female. It makes me angry how I'm forced to struggle to find help while someone who's 400 lbs can just get disability so easily, simply by listing off their self-inflicted conditions.

I have a permanent impairment to my right leg, roughly 13% loss of use. I know how you feel and it disgusts me to no end.

Bullshit. They all have full control over it except for severe mental retardation like Prader-Willi. Some things make it a little harder, but if you reach adulthood incapable of dealing with shit, you're still a child.

Unless they have that disorder that causes you to feel like you're starving 24/7, which is insanely rare, even those people have control over their weight. Things like thyroid problems can explain 30 extra pounds, not 300.

I look forward to seeing legal battles where this gets brought up as case law against those claiming discrimination due to lateness, overly long lunches, and frequent absenteeism.

Finally it will get addressed! Obeasts seem to be the only ones (99% at least) that have these issues in the workplace.

Well, this is going to be a fun legal battle, eh?

On one side, if this case were to win, Companies would have to have potential applicants list any disabilities to ensure they don't get sued AFTER the person is turned down.

On the other side, the ADA screaming about people shouldn't have to list their disabilities because it could potentially get them turned away from a job.

I'll grab the popcorn.

I hope to see the rule go lower. Will not hire if BMI is over 30 unless applicant can prove they are Arnold or Vin Disel.

I know shit about law, but this actually sounds bad. Read the court documents.

Their decision had nothing to do with obesity being self-inflicted, but with whether or not this particular fat fuck was impaired by his weight. Sounds like this guy's downfall was the fact the he's one of those "I'm healthy despite my weight and can do anything a normal human can!!!" retards. His claim to disability was essentially like saying "Yea I'm not disabled, but give me disability!" Which of course got laughed out of court.

But this means that any fatty who wants to claim disability just has say that their obesity is making their day-to-day activities impossible, and tadaa... disabled!

They don't have dignity. "Ah cuhnt mov no moa bcuz of muh diabeetees, so u see muh obisity iz a disubiluhteh, yo honur!"

Sorry, to me this sounds like one fatty took the bullet so the rest will now have an even easier time scamming the system.

The expert witness stated there was no underlying medical cause for his obesity.

No worries, I made a reply earlier with arguments that employers can legally make physical ability requirements that filter out the fatties claiming condishuns

Edit: oops, that did not turn out the way I intended.

"As a result of the ruling, plaintiff attorneys will “ 'be looking to attach a physiological impairment or condition as the cause of the obesity,” said Peter J. Petesch, a shareholder at Littler Mendelson P.C. in Washington. “Meanwhile, defendants will be looking to distance the characteristic from a physiological condition.' if obesity is a disability then so is meth addiction.

Being addicted isn't covered, but fucking yourself up is. So technically, it is covered if you do a shit ton of meth.

I'm an alcoholic, and I never understood how alcoholism could be covered as a disease/disability in a way that protects your job. I did that shit to myself. Yea, it's nowhere near as easy as "don't pick up the bottle" as it seems from the outside, but it shouldn't be protected.

I never understood why drug addiction isn't covered for your job (unless it's just because it's illegal?) When I was an active alcoholic I was able to do my job and everything, but I was afraid to tell my boss I had to get impatient help. From my understanding it's covered under disability for that specific reason. You can't walk into work unable to do your job because you're an alcoholic; but if you need to leave to get help you're covered.

That's the way I always saw it and the way it worked out for me.

grabs popcorn

Dis gun be gude. As a nursing student, I am so looking forward to class later when fellow hammy students REEEEEEEEE about their rights. Fatties have the right to be fat, but they don't have the right to demand that others bear the weight of their delusional dietary choices. [Fat nursing student] I eat healthy while it snacks on crackers during class and brags about the 1,000 kcal salad it had for lunch 2 days ago.

Edit: I don't agree with the recommendation that employers are to accommodate their obese employees. This is a slippery slope of fats trying to claim discrimination and REEEEEing on every social media area that it can about how XYZ company hates (insert minority or fat-induced disability).

The fatties haven't caught on to this yet, too busy greasing up their thighs so they can fit into their "fatkinis" for memorial day. I can't wait until this news dawns on them though it's gonna hit harder than a walk up a flight of stairs.

Fucking hams want it both ways. They want to pretend they are perfectly healthy but as soon as anything goes against them now it's discrimination because they have an uncontrollable disease.
