No force, coercion, or pressure used = not rape. Sex with children can be consensual and therefore acceptable in some situations. I can't say if this specific ruling is good or bad without knowing more about what happened though.

What this guys said.

The law says they cannot legally enter into any type of agreement, thus cannot consent. Thus the default is no for Sex, and as it is for most things. Cannot consent, Age of Consent. Not of age to do so.

Age of consent is part of what the government says is rape, not necessarily real rape.

while i sort of agree with you, there are grey zones.. i mean, this kid is a 10 year old so thats wrong.

but say, a 13/14 year old and a 23 year old.. or 50 year old.

once a girl has had her period, shes ready (as far as her body is concerned).. < not taking mental readiness into consideration here.

and given the excessive amounts of hormones girls are recieving its not such a huge surprise to imagine a ten year old girl getting her period.

that being said i am a father and would kill any 20+ year old who tried or did rape my 10 year old daugter.

im just saying that there is a very very very very specific grey zone that can exist but is rare.

Maybe teenage sex isn’t rape, as in two teenagers mutually consenting to each other.... but 23 and 10? I don’t think that a 10 yr old girl is able to make decisions like that...... should be a crime.....

Ya agreed, 10 year olds have great wisdom and perception: essentially an adult at this point.
