You also see this abuse in the tech sector. I am a freelance designer/ dev and normally companies want to hire me as an independent contractor for obvious reasons. But then they try to dictate where I work "We want you to work only from the office. No remote work.". Or, they expect me to work from 9-5 or whatever crazy hours they other staff are working. One place expected me to work 12-14 hour days because they were a struggling startup. Worked from my home office, reasonable hours and got the project done before the deadline. But, they still treated me like a pariah and it was rather quite insulting to be talked down to. When freelancing sometimes you just suck it up when they are paying the bills.

drivers are also work under federal laws (fmcsa) so they can only work so many hours a day and week.

in trucking putting drivers as contractors is a dirty way to get other people to lay for all of your operarting expenses.

I responded to someone else about the same time as your post, which is a little bit more detailed.

I also started to see contract labor in communications before I left. I used to build, upgrade and maintain communication (cell phone) towers. The work required us to travel across the country working on these systems and we would be away from home for months at a time.

Someone got the bright idea to offer us $5 more an hour and turn us all into contract labor. We would also be required to supply all our own transportation, safety gear, hotels, food expenses.

Alot of the companies jumped on it and caused alot of the experienced guys to leave. Average pay was $20 - 25 an hour for experienced guys + $50 - 90 per day for per deim which covered food and hotels.

With the contracts we would have lost that per deim money.

If you're going to operate a semi truck with no experience and no reserve funds you could end up in bankruptcy inside your first year of driving a truck. All it takes is one break down which can easily run $10,000.

The company isn't going to lose their truck but they'll make that contract driver pay them back for those repairs, then before that breakdown is payed off. The driver can easily find themselves buying a new set of tires, a $600 oil change and pm service, another $5,000 - $10,000 breakdown. Now this driver is a debt slave, and all their statements have a negative balance until all this debt is paid off.

So each week they don't get a paycheck. But wait there is relief each week they can take out a loan against their statement up to $500. Which increases that further.

Isn't modern day slavery nice?

Crazy. Thanks for the info. More people need to understand the ins and outs of differing fields to truly understand the modern day slavery many live in.

I see this a lot out there. Independent contractor comes with some pretty specific guidelines. Like you can't tell them when to work. You can't tell them when to show up or leave. It's AMAZING to me how many business owners are so bad at business. Well, or shady at it.

"You are not an independent contractor if you perform services that can be controlled by an employer (what will be done and how it will be done). This applies even if you are given freedom of action. What matters is that the employer has the legal right to control the details of how the services are performed."

a lot of the training companies will trick drivers into leasing a truck by showing them some really good settlements ( paychecks). They'll tell them that they can make that every week and can make up to $150,000 a year.

The reality is that to make $150k a year they have to be on the road a minimum of 11 full months out of the year. Then run that truck 3,000 miles a week.

After everything is paid for they'll be lucky to put $30,000 into their pockets.

The real kicker is that these drivers aren't paying for new trucks, after interest theyre paying full price for one of the trucks the company no longer wants.

They can also turn down work but theres nothing stopping the companies from withholding work to punish the drivers.
