Wow. A directly related case involving websites. Yeah if imgur had a legit claim to slimgur, voat definitely should have a claim on upvoated. Now the question is when did Reddit buy upvoated.com? As long as it's after voat was founded, I'd say there's a case. Also, (please don't downvoat if this is a dumb question) but could someone besides Atko file a suit against upvoated, or does it have to be the voat owner?

I didn't know that. Thanks for the info, but:
Reddit has a much stronger claim to upvoated than Slimgur as they are already using upvoted.com commercially ... We, the old users of Voat know what they are doing and why, but can we prove that in a court?

Also, can Voat successfully fight Reddit's usage of upvoted in a court?

As far as I see things, @Atko can lay claim on the domain at any point in time, citing an infringement on his Voat trademark by the offending entity. Once he puts his claim in with ICANN, they would review his case and then transfer the domain over to him if they determine that his claim to said domain is legal.

Apparently trademark infringement is outside of ICANN's authority. Looks like you have to take it to a court, which sucks.

Alternatively, you can seek help from an Ombudsman. I've never used one in-regards to trademark infringement, but have used one to sue an ISP a few years ago and won the case within the month.

This was during the Internet dialup days in the very early 00s for me. They tried to charge me $2000 AUD for interstate calls even when their setup wizard did not cover swapping states, which was rather hilarious. I grabbed my camcorder and recorded the setup wizard procedure, and submitted my case to the ombudsman. He took a look at it and took my case right there on the spot. Month later a cheque for $2000 AUD was handed to me to pay off the bill (don't ask why they did it that way /sigh).

I've also used an ombudsman when I sued a car manufacturer (I will not specify who out of privacy) for one of their shoddy engines on a specific model/year car.

In each case, I did a tonne of prep work though. I've compiled numerous documents which included images, videos, audio recordings, etc. I was doing the ombudsman's work for him to make the win easier.

Nah, it would have to be the owner behind the trademark. You can't just do things 'in the name of' someone else when it comes to such things. In other words, you can't write a cheque and sign it with Bill Gate's name, as much as I'd love a billion dollars haha

It's possible to give a limited power of attorney that would enable the specified individuals to act within a narrowly prescribed set of topics, such as to pursue this infringement.

AFAIK they also register ed upvoted.com, but they are cybersquatting on the upvoatedupvoated.com name with no intention of using it to hurt one of their competitors (voat).

It's a pretty clear case of trademark infringement.
