Drunk driving should be illegal and we shouldn't only be allowed to punish you after you actually hurt someone. Just because you got lucky this time, doesn't mean you will be lucky next time and someone who has already shown they are willing to drink and drive should be expected that they will do so again.

In regards to statutory rape, I personally think that there should be a window, for like 13+ where if the prosecution can prove you slept with them, bam, you are committing a crime. Your sentence can then be completely commuted though, if you can show that the average person would have also mistaken the age of the person involved.

For example, the man the recently slept with the girl from Tinder, it sounds like he legitimately thought she was of age and the evidence supports that, he shouldn't have been punished.

Sure, but speeding is also "illegal", and what do we mean by "punish"? There's a whole lot of punishments short of imprisonment and a rap sheet. License suspension is a serious pain in the ass for most people in most places. Mandatory DUI school is also a pain in the ass and more likely to lead to reform than giving somebody a rap sheet.

The argument isn't that strict liability laws shouldn't exist, it's that they shouldn't be used for everything, and should be applied in very specific ways.
