Cool. I think it boils down to hearsay. This is trial court, not appellate. Even at appellate, Ginsberg said the parties are primary. Here, the parties have washed their hands and moved on.

I'm actually going to enjoy reading these briefs. Seeing accomplished lawyers stain their own reputations with legal gymnastics will be satisfying. The Flynn case is so cut and dry, they can't possibly have any real legal reasoning.

The more I read about this the more I think something is afoot. Here is a Question... Who will file a brief? What will it say? As an employer I could hand a task to one person and it would be completed as reQuested but I could also hand it to some one that will Predictably fuck it up. I have a feeling we are about to see an epic example of the latter.
